6. CONSUMER’S RIGHT TO CANCELLATION. YOU MAY CANCEL THIS CONTRACT WITHOUT ANY PENALTY OR FURTHER OBLIGATION WITHIN THREE (3) DAYS FROM THE AGREEMENT DATE; Notice of cancellation shall be delivered in writing OR by email to memberships@remedyplace.com subscribed by the buyer. Such notice shall be accompanied by the contract forms, membership cards, and any other documents of evidence of membership previously delivered to the buyer. All monies paid pursuant to such contract shall be refunded within fifteen business days of receipt of such notice of cancellation. If the buyer has executed any credit or loan agreement to pay for all or part of health club services, any such negotiable instrument executed by the buyer shall also be returned within fifteen days.
7. CONTRACT RATE; Your special founding membership rate is valid for 365 days or 1 year from the date of your membership activation. 
8. AUTO-PAY AGREEMENT; Memberships will have automatic withdrawal on the date of purchase. As payment for your enrollment in our memberships, you agree to pay Remedy Place (Aceso House, LLC., dba) directly.
9. UPFRONT MEMBERSHIPS; Memberships paid in full at the contract start date only under special circumstances may be refunded for 80% of the initial contract price.
10. REFUNDS; There will be no refunds for processed charges. If a refund is agreed to after an auto payment has run, it will be credited less a 10% merchant services fee reimbursement. 
11. MEMBERSHIP PAUSE;  Memberships may pause active memberships for a fee of $50/month in order to placehold their membership spot within Remedy Place’s 200 memberships per club. You must submit your pause request via email to memberships@remedyplace.com. If a request was not submitted at least 48 hours prior to the billing cycle, there will be no refund of membership contract payment. 
12. APPOINTMENT CANCELLATION POLICY: In order to provide the best possible experience for our members and guests, we require 24 hours written or verbal notice in order to cancel or reschedule an appointment with no penalty. Failure to do so will result in the deduction of the Membership credit or full charge for the appointment and no refund will be provided. If you do not reach anyone, please leave a voicemail, or follow up with an email to hello@remedyplace.com to ensure we receive a time-stamped cancellation request. 
13. FOUNDING MEMBERSHIP CANCELLATION; You may end your founding membership at the end of your one (1) year contract under the following guidelines. A formal membership cancellation request must be sent to memberships@remedyplace.com 5 or more days from the renewal date and will only be processed upon submission of a “Member Cancellation Survey”.  Any Membership cancellation requests received 4 or less days before the next billing cycle are subject to a $100.00 termination fee. All Founding Memberships are contracted for 1 year. In extreme circumstances, membership may be cancelled, however upon rejoining, founding members will not receive their founding rates. 
14. FORFEITURE OF UPFRONT MEMBERSHIP BONUS: If an upfront member cancels for any reason, they forfeit any remaining balance of the $750.00 club credit given to Founding Members that pay for their founding year upfront. 
15. ROLLOVER CREDITS; Credits do not rollover automatically if unused and only under special circumstances do we allow unused credits to transfer from previous months. Credits shall not exceed double of original allotted monthly credits. In addition, only immediate previous months credits shall be available to rollover to current months credit total. 
16. UNUSED MEMBERSHIP CREDITS; Any existing credits for Tech-Remedies, IV Drips, Ice Baths, Classes, and Unlimited Cryo are null & void upon membership cancellation and do not hold any monetary value. 

17. TRANSFERABILITY OF MEMBER CREDITS: Membership credits are transferable to other guests and non-members only with written approval from the member. 
18. ADDITIONAL RIGHTS TO CANCELLATION; You may also cancel this contract with 45 days written notice by certified or registered mail for any of the following reasons: a) If, upon a doctor’s order, you cannot physically receive the services because of significant physical disability for a period in excess of six months. b) If you die, your estate shall be relieved of any further obligation for payment under the contract not then due and owing. c) If you move your residence more than thirty miles from any club operated by seller (Aceso House, LLC dba Remedy Place) with satisfactory proof of new residence. d) If the services of the Club cease to be offered as stated in the contract. e) All monies, except any initiation fee, paid pursuant to such contract canceled for the reasons in this paragraph shall be refunded provided, however, that the seller may retain the expenses incurred and the portion of the total price representing the services used or completed, and further provided, that the seller may demand the reasonable cost of goods and services which the buyer consumed or wishes to retain after the cancellation of the contract. In no instance shall the seller demand more than the full contract price from the buyer. If the buyer has executed any credit or loan agreement to pay for all or part of the health club services, such negotiable instrument executed by the buyer shall also be returned within fifteen days. Promotional Months: Member agrees that if Member received any free months as an inducement to enter into this Agreement or as a result of referring new members, such free months shall not be considered in computing the amount of any refund to which Member shall be entitled.
19. CLUB OPERATING SCHEDULE; Remedy Place may modify the operating hours and may close the club on national holidays, for special events, and up to 15 days per year for necessary maintenance. Modifications and closures, which does not relieve the member of their payment obligations under any circumstance. 
20. BUYER’S OBLIGATIONS: Buyer shall not be relieved of Buyer’s obligations to make payments agreed to, and no deduction from any payments shall be made because of Member’s failure to use the Club’s facilities. (Member dues are for the period of contract and are in no way related to or adjusted based on, actual usage of the Club.) 
21. ENTIRE AGREEMENT: Except for the rules, regulations, and schedules posted at the Club or issued orally by Remedy Place from time to time at its discretion, all of which are incorporated into this agreement, this contract constitutes the entire and exclusive agreement between the parties relating to the subject matter hereto and supersedes any oral or other written understanding. This contract only may be modified in writing executed by a duly authorized representative of Remedy Place. Employees are not authorized to make any independent agreements with any Member/Buyer.
22. UNPAID BALANCES: Members will not be permitted to use any Club until all fees are current. Buyer and/or Member is obligated to pay any collection and/or legal costs incurred by Remedy Place for collection of any fees. Annual dues must be paid by 12:00 midnight on the anniversary date or Club privileges will be suspended. Remedy Place reserves the right to charge balances and overdue balances to their current account under the Electronic Funds Transfer Authorization. If any check or credit card charge payable to Remedy Place is not honored, Management will assess a $25 charge for each check and credit card rejected and collects the current and past-due balance in any subsequent month. To the extent that Buyer and Member is not the same person, Member shall be obligated to make all payments that Buyer fails or has failed to make (including past and future payments for use of the Club).
23. VALUABLES AND PERSONAL PROPERTY: Members are urged to avoid bringing valuables into club premises. Remedy Place shall not be liable for the loss of or theft of, or damage to, the personal property of member or guests, including items left in lockers, with the coat check or elsewhere in the Club. 
24. PRICING: It is within our discretion to amend our membership fees at any time, and we will notify you in advance if there are to be any changes to the amount, date, or frequency of the payment of your membership fees. After the first 12 months of membership, Remedy Place reserves the right to increase the monthly or annual fee and will provide 30 days’ notice to all Members regarding any such change in pricing; provided that pricing for Members who joined as part of a corporate program are subject to the pricing agreement between Seller and Member’s employer or corporate sponsor. 
25. REVOCATION OF MEMBERSHIP: Remedy Place reserves the right to revoke and cancel this membership at any time for any reason, in which case Buyer/Member will, no later than fifteen (15) days after such cancellation, receive a refund of all monies paid pursuant to this Agreement (except initiation fee), provided that Seller may retain expenses incurred or the portion of the total price of this Agreement representing the services used or completed, and provided further, that Seller may demand the reasonable cost of goods and services which the Buyer/Member has consumed or wishes to retain after cancellation.
26. PRIVACY POLICY; We will use the personal information you provide us in connection with your membership, in accordance with our Privacy Policy.
27. WAIVER OF LIABILITY: Member assumes full responsibility for his or her use of the facility and releases Remedy Place from any and all claims, including those caused in whole or in part, by the negligence of Remedy Place and shall indemnify Remedy Place, the owner of the club location the Member is utilizing, its affiliates, agents and employees against any and all liability arising out of the use of the facilities.

By validating the box above for this  agreement you acknowledge that you have read, understand, and agree to the Remedy Place Terms and Conditions numbered (1) through (27) above.

A signed copy of this document will be required upon full membership payment, due August 20th, 2022. This signed copy will be returned to you for your records upon the date signed.
